The Grand National Assembly of Turkey (TBMM) approved the law known to the public as the “Framework Law” with 468 votes, as part of the “Terror-Free Turkey” project. This law not only provides a legal foundation for a new solution process but also covers crimes associated with the terrorist organization PKK/KCK.
The content of the law includes provisions regarding the disarmament actions of the PKK/KCK and the termination of its organizational activities. After these actions are detected by security institutions, legal consequences are expected to follow. Specifically, such actions, once verified by the National Security Council (MGK), will allow for the reevaluation of certain laws.
Content of the Framework Law
The mentioned law organically covers crimes related to the PKK, such as membership in the organization, providing assistance, and conducting propaganda on behalf of the organization. With the enactment of the law, it aims to produce specific legal consequences not only for prisoners but also for other individuals connected to the organization.
Government officials emphasize that this framework law should not be interpreted as a general amnesty. It is stated in the law that the disarmament of the PKK is established as a strict prerequisite. On the other hand, prominent criticisms show that this situation has sparked discussions in the public about “an amnesty application.”
Furthermore, crimes of intentional murder and those requiring life imprisonment committed before June 1, 2005 are excluded from this arrangement. Official authorities specifically highlight that individuals associated with the PKK will not be automatically released.
National Solidarity and Social Integration
The National Solidarity, Brotherhood, and Democracy Commission formed by the TBMM has identified its objectives to remove the issue of terrorism from Turkey’s agenda and emphasized social integration. It has been stated that this process should progress within the principles of the rule of law.
Experts express that the main objective of this law is to predefine the legal consequences that will emerge when the PKK disarms and dissolves. Therefore, they believe this law should be viewed not only as part of the fight against terrorism but also as a step towards social peace.
